The fine print.

This Privacy Policy describes how BrandCapsule, Inc. ("BrandCapsule," "we," "us," or "our") collects, uses, and shares personal information when you visit brandcapsule.ai and use our AI Discovery Intelligence platform and related services (collectively, the "Services").

By using our Services or submitting any form on our website, you agree to the practices described in this Privacy Policy. Beyond this Privacy Policy, your use of our Services is also subject to our Terms of Use.

1. Information We Collect

Contact and inquiry information. When you request a demo, submit our contact form, request a free AI Discovery Snapshot, or inquire about our Services, we collect your first name, last name, email address, company name, website URL, and role type.

Account information. When you create an account, we collect your email address, name, and company name.

Payment information. If you subscribe to a paid plan, your payment information is collected directly by our third-party payment processor, Stripe. We do not see or store your full card number or CVV. Stripe provides us with a payment token, card type, expiration date, and last four digits for reference.

Communications. If you contact us by email or through our support channels, we collect the contents of your messages and any attachments.

Public chatbot sessions. If you use the chat feature on our marketing website, we collect and store the messages you type, including from visitors who have not created an account.

Brand and query data. When using the platform, you submit brand names, competitor names, category descriptions, and buyer question prompts ("Query Data") used to generate your AI Discovery Intelligence outputs.

Analyst chat sessions. When you use the AI Discovery Analyst feature, we store your questions and the Analyst’s responses in full, so you can review your own session history.

Device and usage information. When you access brandcapsule.ai, we automatically collect your IP address, browser type and version, device type and operating system, referring URL, pages visited, and time spent.

Cookies and similar technologies. We use cookies and similar tracking technologies to operate the platform, understand how visitors use our site, and support marketing. Refer to our Cookie Policy for details.

2. How We Use Your Information

We use the personal information we collect to:

• Deliver and operate the AI Discovery Intelligence Services, including processing your Query Data through third-party AI model APIs (ChatGPT, Claude, Gemini).
• Process your Snapshot request and deliver your diagnostic results.
• Process subscription payments and manage your account through Stripe.
• Communicate with you about your account, subscription, pricing changes, and service updates.
• Respond to your contact, demo, or inquiry requests.
• Improve the platform and service quality using anonymized, aggregated usage patterns. We do not use your brand-specific Query Data or platform outputs to train third-party AI models.
• Send you marketing communications where permitted and with the ability to opt out.
• Generate anonymized or aggregated data for any lawful purpose.
• Detect and prevent fraud, abuse, and Terms violations.
• Comply with applicable legal obligations.

We do not sell your personal information. We do not use your information for behavioral advertising served by third-party ad networks without your consent.

3. How We Share Your Information

Third-party AI model providers. To generate platform outputs, BrandCapsule transmits your Query Data to third-party AI language model APIs. We transmit only the Query Data necessary to generate your output. To generate reports, we may transmit brand names, category-level analytical questions, and content from your public website (which we crawl for analysis) to AI providers (Anthropic, OpenAI, Google). We do not transmit passwords, payment information, or your account email address to these providers in the ordinary course of report generation. Two exceptions to be aware of: (1) if your own public website contains contact details for staff, those pages may be included in the content we send for analysis; (2) messages you type into our chat interfaces are forwarded to the AI that answers you — as with any AI assistant, avoid pasting sensitive personal data you don’t want a third-party AI to process. Current AI model providers include:

• OpenAI, Inc. (ChatGPT) — openai.com/policies/privacy-policy
• Anthropic, PBC (Claude) — anthropic.com/privacy
• Google LLC (Gemini) — policies.google.com/privacy

Service providers and vendors. We share personal information with vendors who help us operate our Services, including Stripe (payment processing), analytics providers, cloud hosting providers, and email and CRM tools. These vendors process data only on our behalf under confidentiality agreements.

PostHog. Within the logged-in platform, we share your email address, name, company name, and role with PostHog, a product analytics provider, to understand how customers use the Services.

Analytics partners. We use analytics services to understand how visitors use our site. These services may collect information about your use of other websites. See Section 5 (Cookies and Tracking Technologies) for details. We work with PostHog and Cloudflare for analytics purposes.

Advertising partners. We do not use advertising partners.

Legal and compliance. We may disclose your information where we believe in good faith that disclosure is necessary to comply with applicable law, legal process, or a lawful government request, court order, or government demand, or to protect the rights, property, or safety of BrandCapsule, our users, or third parties.

Business transfers. In the event of a merger, acquisition, or sale of assets, your personal information may be transferred to the acquiring entity. We will provide notice of material changes to data handling practices.

With your consent. We may share your information for any other purpose disclosed to you with your permission.

4. Your Choices and Rights

Marketing communications. You can unsubscribe from our marketing emails via the unsubscribe link in any email. You will continue to receive transactional and account communications.

Do Not Track. There is no accepted standard for responding to Do Not Track signals. We do not currently respond to such signals.

5. Cookies and Tracking Technologies

Our website uses cookies as described in our Cookie Policy.

6. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purpose for which it was collected.

You may contact us at hello@brandcapsule.ai with questions about your information or to request that we delete it. We will respond to your request and take reasonable steps to address it in accordance with applicable law.

7. Security

We implement reasonable technical and organizational security measures designed to protect your personal information:

• Passwords hashed with bcrypt
• Payment card data never touches BrandCapsule’s servers (Stripe-hosted checkout only)
• Payment and email webhooks cryptographically signature-verified before any account change
• Role-based access controls on admin and customer data surfaces
• Secrets held in environment configuration, never in source code
• Database hosted on MongoDB Atlas, which encrypts data at rest
• Traffic served over HTTPS

No electronic transmission or storage of information is entirely secure. We cannot guarantee the absolute security of your information. In the event of a data breach affecting your personal information, we will notify affected users and applicable regulatory authorities as required by law.

8. Children’s Privacy

Our Services are not directed to individuals under 18 years of age. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected personal information from a minor, contact us immediately at hello@brandcapsule.ai and we will delete it.

9. Changes to This Policy

We may update this Privacy Policy from time to time. For material changes, we will notify account holders by email and/or in-app notification at least 30 days before changes take effect. Non-material updates will be reflected in the Last Updated date at the top of this page. Continued use of the Services after changes take effect constitutes acceptance of the updated policy.
